1. Acceptance of these terms

Welcome to Pick10Wise. These Terms of Use ("Terms") govern your access to and use of pick10wise.com (the "Site"), owned and operated by Better Days Health LLC, a limited liability company registered in the State of Wyoming, United States ("we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Site.

You must be at least 13 years old to use the Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or guardian.

2. About the Site

Pick10Wise publishes product rankings, comparisons, and buying guides based on our own research and evaluation methodology, which is described on our How We Select Products page.

We are not a retailer. We do not sell, ship, or fulfill any products. All purchases are made on third-party websites (such as Amazon.com), under those retailers' own terms of sale, return policies, and warranties. Any issue with an order — pricing, shipping, returns, defects, warranty claims — must be resolved directly with the retailer or manufacturer.

3. Informational purposes only

All content on the Site — including rankings, scores, comparisons, and buying guides — is provided for general informational purposes only. It reflects our research, analysis, and editorial opinion at the time of publication.

Our content is not professional advice of any kind, including medical, health, safety, financial, or legal advice. Products that relate to health or wellness are covered from a consumer-comparison perspective only; always consult a qualified professional before making decisions that could affect your health or safety, and always follow the manufacturer's instructions and warnings for any product you purchase.

Your purchase decisions are your own responsibility. We encourage you to do additional research before buying any product.

4. Product information, prices, and availability

We work to keep product information accurate and up to date, but specifications, features, prices, and availability change frequently and are controlled by retailers and manufacturers — not by us. We do not warrant that any product information on the Site is complete, current, or error-free.

Any price or availability information displayed on a retailer's website at the time of purchase will apply to your order, regardless of what is shown on the Site. Product images are illustrative and may differ from the actual product.

5. Affiliate relationships

6. Intellectual property

The Site and all of its original content — including text, rankings, scores, evaluation methodology, graphics, logos, and design — are the property of Better Days Health LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site's content for personal, non-commercial use. You may share links to our pages freely. However, you may not, without our prior written permission:

• Copy, reproduce, republish, or redistribute substantial portions of our content;
• Use our content, rankings, or scores for commercial purposes, including in marketing materials;
• Use automated tools (scrapers, bots, crawlers) to extract content or data from the Site, except standard search engine indexing;
• Use our content to train, fine-tune, or develop machine learning or AI models;
• Remove or alter any copyright, trademark, or attribution notices.

"Pick10Wise" and the Pick10Wise logo are trademarks of Better Days Health LLC. Third-party trademarks (including Amazon and product brand names) belong to their respective owners; their appearance on the Site does not imply endorsement or affiliation.

7. Acceptable use

When using the Site, you agree not to:

• Violate any applicable law or regulation;
• Interfere with or disrupt the Site, its servers, or its security features;
• Attempt to gain unauthorized access to any part of the Site or its systems;
• Introduce viruses, malware, or any other harmful code;
• Impersonate Pick10Wise, Better Days Health LLC, or any of our team members;
• Use the Site in any way that could damage, disable, or impair it.

We reserve the right to restrict or terminate access to the Site for anyone who violates these Terms.

8. Third-party websites

The Site contains links to third-party websites, including retailers. These links are provided for your convenience. We do not control third-party websites and are not responsible for their content, accuracy, availability, policies, or practices. Accessing any third-party website is at your own risk and subject to that website's terms and privacy policy.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES ABOUT ANY PRODUCT FEATURED ON THE SITE — ALL PRODUCT WARRANTIES, IF ANY, ARE PROVIDED BY THE MANUFACTURER OR RETAILER.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BETTER DAYS HEALTH LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, ANY CONTENT ON THE SITE, OR ANY PRODUCT PURCHASED THROUGH LINKS ON THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Better Days Health LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Site.

12. Copyright complaints (DMCA)

We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to Contact.pick10wise@gmail.com with the subject line "DMCA Notice," including:

• Identification of the copyrighted work you claim has been infringed;
• The URL of the material on our Site you claim is infringing;
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
• Your physical or electronic signature.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles.

Before filing any legal claim, you agree to first contact us at Contact.pick10wise@gmail.com and attempt to resolve the dispute informally for at least thirty (30) days. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

To the extent permitted by law, you and we each waive the right to a jury trial and agree that any claim must be brought in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be highlighted with a notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

15. General provisions

• Entire agreement. These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and us regarding the Site.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Assignment. You may not assign your rights under these Terms. We may assign our rights and obligations to a successor in connection with a merger, acquisition, or sale of assets.
